Terms of use
Provisional version, under legal review. It will be replaced by the final version before any contractual commitment.
1. Publisher and purpose
Kalasi is online software for managing schools and training centres, published by BIKUS SERVICES SARL, Bonamoussadi, Douala, Cameroon (PO Box 15785, Tax ID M071913913914690H, Trade Register RC/DLBB/2019/B/329), hereinafter "the publisher". These terms govern access to and use of Kalasi by a school ("the school") and by the people the school gives access to.
2. Accounts and access responsibility
The school's owner creates the school account, then the accounts of its users (management, secretariat, cashier, teachers, parents, students). They guarantee the accuracy of the information provided, keep credentials confidential and are responsible for actions carried out with their school's accounts. Any temporary password must be replaced at first sign-in.
3. Free trial
Online sign-up opens a free trial whose length and plan are shown on the website at sign-up. The trial requires no bank card and no commitment. When it ends, access is suspended after the grace period in article 4, unless a subscription is taken.
4. Subscription and payment
Plans and their prices, in CFA francs, are shown on the website. The subscription is paid in advance for 1, 3, 6 or 12 months, by the means shown in the application (Mobile Money, bank transfer, cash). The school declares its payment with its reference; the subscription is extended once the publisher has confirmed receipt. A plan change takes effect on that confirmation, with no proration.
After the due date, the school has three days of grace. After that, access is suspended; data is kept and access resumes as soon as payment is made. The publisher may change its prices: the change only applies to the following period and is announced before it takes effect.
5. School data
The school remains the owner of its data (students, families, grades, attendance, tuition payments) and is responsible for it. Kalasi processes it on the school's behalf, solely to provide the service. The school guarantees it has informed families and has the legal grounds needed for this processing. Details are in the privacy policy.
6. Acceptable use
The school shall not use Kalasi unlawfully, attempt to access another school's data, undermine the security or proper operation of the service, or resell or make Kalasi available to third parties without the publisher's written consent.
7. Availability and security
The publisher uses reasonable means to ensure availability and security of the service: passwords stored hashed, secure connection, strict separation between schools, role-based permissions, log of corrections and cancellations. It does not guarantee uninterrupted service, in particular during maintenance.
8. Intellectual property
The Kalasi software, its brand and its content remain the publisher's property. The subscription gives the school a personal, non-exclusive, non-transferable right of use for the duration of the subscription.
9. Liability
The publisher is not responsible for the school's data-entry errors, nor for educational, disciplinary or financial decisions taken from the data entered. To the extent permitted by law, its liability is limited to the amounts paid by the school for the current subscription period.
10. Suspension and termination
The school may stop using Kalasi at any time; the period already paid is not refunded, unless the publisher agrees in writing. The publisher may suspend access in case of serious breach of these terms. When the contract ends, the school may request an export of its data within a period communicated at that time; after that, data is deleted or anonymised.
11. Changes to these terms
The publisher may change these terms. Schools are informed in the application or by email before they take effect; continuing to use Kalasi after that date constitutes acceptance.
12. Governing law
These terms are governed by Cameroonian law. Failing an amicable settlement, the competent courts of Douala will hear the dispute.
